Terms & Conditions
- Failure to attend class does not signify or imply notification to cancel this agreement. This agreement may be cancelled for any reason without penalty or further obligation within 14 days from the date of this agreement. Cancellation shall be made in writing and submitted via an official TKA Cancellation Form. All money paid shall be refunded within 30 days of the school's receipt of a valid cancellation notice, less any expenses reasonably incurred and the portion of the total price representing services used or completed, calculated at $35 per hour. Down payments are non-refundable after the 14-day period.
- A student's failure to continue lessons during the notification period does not relieve the obligation to pay the remaining tuition balance in full.
- Undersigned assumes all responsibility for any costs of collection, including but not limited to reasonable collection agency fees, court costs, reasonable attorney's fees, and applicable late charges, that may be incurred for default payments.
- School administrators may make any modifications in the class schedule as deemed necessary. Such modification does not relieve the undersigned of their payment obligations under any circumstances.
- Some memberships may include a minimum term commitment as specified in the membership agreement. Where a minimum term applies, the minimum term commences from the date of the first successful payment, not the date of signing. Cancellation during the minimum term does not remove the obligation to complete all payments within that minimum term unless permitted under the Consumer Privileges section of this agreement.
- It is assumed that students will attend an average of 2 classes per week (unless specified differently herein).
- The tuition cost for martial arts programs are based on a 48 week year. Payments are scheduled for the calendar year of 52 weeks.
- School administrators may close the school on national holidays, for the purpose of special events, and a period not exceeding three weeks per year for necessary maintenance and other purposes without affecting scheduled tuition payments.
- School administrators and those acting under its authority reserve the right to use photographs, video tapes, artwork or other likenesses of the student for marketing, trade, publishing or any other lawful purpose.
- Full payment of tuition fees does not guarantee Belt certification by school administrators.
- Membership is non-cancellable and non-transferable except as stated herein.
- A student's failure to attend scheduled lessons relieves the obligation of the school to provide lessons after the program end date.
- Undersigned authorises the use of a disclosed e-mail address for billing purposes and acknowledges that e-mail text may include financial information pertaining to the membership.
Ongoing Memberships
- Cancellation of ongoing membership requires the completion of an authorised TKA Cancellation Form, which can be obtained from our member portal. All cancellation requests are subject to a mandatory Exit Interview with a TKA representative. No cancellation will be processed until this interview has been completed, and the cancellation notice period commences from the date of the Exit Interview, not the date the Cancellation Form is submitted. If the Exit Interview is not completed, the membership will remain active and billing will continue in line with this agreement. The membership is cancelled when all payments due within the notice period are paid in full. If a notice period is not specified, a minimum of 30 days notice is implied. The student retains membership rights and privileges until the notice period expires.
- "TERM" agreements are non-cancellable unless stated herein. School administrators may raise the tuition rate of ongoing memberships providing advance notice equal to the cancellation notice stated herein.
Membership Hold Policy
- Members may request a temporary hold on their membership, pausing active participation whilst maintaining membership status. A hold fee of $6.75 per week applies for the duration of the hold period.
- The minimum hold period is two (2) weeks. Holds of less than two weeks will not be approved.
- Members may hold their membership for a maximum of four (4) weeks per calendar year (1 January to 31 December). This allowance does not carry over between calendar years.
- Holds are not available during the months of January, April, or December. Any hold request that falls within or overlaps a restricted month will not be approved, or will be ended on the last day prior to the restricted month commencing.
- Upon returning from a hold, the member is subject to a return lock-in period equal to the length of the hold taken. During this period, the member is not eligible to submit a cancellation notice. For example, a member returning from a four (4) week hold must complete four (4) weeks of active membership before a cancellation notice will be accepted.
- Hold periods do not count toward any minimum membership term and do not reduce the remaining notice obligation at the time of cancellation.
- Hold requests must be submitted in writing to the school no less than five (5) business days prior to the requested hold start date. Holds cannot be applied retrospectively.
- The hold fee is non-refundable. TKA Martial Arts reserves the right to decline any hold request that does not meet the criteria stated herein.
Waiver of Liability
- Student represents that (s)he is in good physical condition, is not suffering from any heart, lung or other bodily ailment and is in all respects physically fit to engage in the martial arts course.
- Students have been advised that strict observance of the rules and regulations relative to martial arts self-defence training is mandated and includes the use of protective equipment. The school does not warrant that the protective equipment will completely eliminate the possibility of accident or injury but will substantially reduce the risk of accident or injury.
- Physical contact will be used by employees of the school, other students and authorised individuals, as part of the course of instruction. Students have been advised of such facts and give full consent to any physical contact as may be required or customary to martial arts training.
- In recognition of the possibility of accident or injury connected with martial arts training, and to the extent permitted by law, student waives any right or cause of action of any kind arising as the result of such activity from which any liability may or could accrue to the school, its officers, agents, employees, or instructors. Nothing in this clause excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law or any liability for negligence that cannot be excluded by law.
Consumer Privileges
- This agreement may be cancelled for any reason without penalty or further obligation within 14 days from the date of this agreement. Cancellation shall be made in writing and mailed to the school by dated mail. All money paid by you shall be refunded by the school within 30 days of receipt of this notice of cancellation. However, the school may retain expenses incurred and the portion of the total price representing the services used and completed based on a $35 hourly rate stated herein.
- Where a student is medically unable to participate in training, supported by a certificate from a treating medical practitioner, the student may take a Medical Hold of up to two (2) months per calendar year, in minimum increments of two (2) weeks. A Medical Hold is not subject to the hold fee in Clause 16, is not subject to the restricted months in Clause 19, and does not give rise to a return lock-in period under Clause 20. A Medical Hold does not count towards any minimum membership term.
- You may cancel this agreement if the student changes residence more than 50km from the school. Cancellation under this section requires written proof of new permanent address, phone number, and name and address of new employer. Cancellation is effective on the date of move. A residence investigation will then be conducted.
- If a student becomes deceased, you shall be relieved of further obligation under this agreement not then due and owing.
There is a $10.00 service charge assessed for any debit that is returned or rejected. Any scheduled payment 4 days past due will incur a late fee of $5 per day until the account is brought up to date.

- Eligibility. The referral program is open to current active members of TKA Blackbelt School with no outstanding fees on their account.
- How it works. Members refer a new student by providing the new student's name at enrolment or by using their unique referral link/code. The referral is only valid if the referred person is not already in our system as a current or past student.
- Reward. The referring member receives 4 weeks free on their membership once the referred student completes their one complimentary trial class and enrols in a paid membership. Each new student is entitled to one free trial only. Rewards are applied to the referring member's account within 7 days of the new enrolment being confirmed.
- Referral limit. Members may receive a maximum of 3 referral rewards per calendar year (1 January – 31 December).
- New student eligibility. The referred person must be a brand new student with no prior enrolment at TKA. Family members living at the same address are excluded unless otherwise approved by management.
- Promotional offers are not referrals. Students who attend TKA through a promotional or complimentary offer, including event vouchers, birthday party passes, free trial promotions, or any other marketing activity, do not constitute a referral. The referral reward is only triggered when a new student enrols as a result of a direct, personal recommendation made by an existing member prior to the student's first visit.
- Non-transferable. Referral rewards have no cash value and cannot be transferred, sold, or exchanged.
- Membership requirement. The referring member must remain an active member at the time the reward is applied. If membership has been cancelled or suspended, the reward will be forfeited.
- Changes & cancellation. TKA Blackbelt School reserves the right to modify, pause, or end the referral program at any time without notice. Any referrals already confirmed before a program change will still be honoured.
- Disputes. TKA's decision on all referral-related matters is final.
